Jakarta – Konfederasi Serikat Pekerja Indonesia (KSPI) menyampaikan, ada sembilan alasan mengapa Rancangan Undang-Undang (RUU) Omnibus Law harus ditolak.
Sembilan alasan tersebut adalah: (1) hilangnya upah minimum, (2) hilangnya pesangon, (3) outsourcing bebas diterapkan di core bisnis, (4) kerja kontrak tanpa batasan waktu, (5) waktu kerja yang eksploitatif, (6) Tenaga Kerja Asing (TKA) buruh kasar berpotensi bebas masuk ke Indonesia, (7) mudah dikenai Pemutusan Hubungan Kerja (PHK), (8) jaminan sosial terancam hilang, dan (9) sanksi pidana hilang.
Terkait dengan pernyataannya yang menyebut RUU Omnibus Law mengatur jam kerja yang eksploitatif, Presiden KSPI, Said Iqbal menyampaikan beberapa alasan.
“Alasan pertama, di dalam RUU Cipta Kerja tidak lagi diatur waktu kerja 7 jam dalam 1 hari dan 40 jam 1 minggu untuk 6 hari kerja atau 8 jam dalam 1 hari dan 40 jam dalam 1 minggu untuk 5 hari kerja. Dengan kata lain, UU No 13 Tahun 2003 mengatur, waktu kerja dilakukan 5 atau 6 hari kerja,” ujar Said dalam siaran persnya, Sabtu (22/2/2020).
Tetapi di dalam RUU Omnibus Law, lanjutnya, tidak ada lagi ketentuan mengenai 5 dan 6 hari kerja.
“Dalam RUU Omnibus Law hanya disebutkan, waktu kerja paling lama 8 jam 1 hari dan 40 jam 1 minggu,” kata Said.
Ia menjelaskan, karena tidak ada batasan hari, bisa saja pekerja dipekerjakan 10 jam dalam sehari selama 4 hari, asalkan totalnya 40 jam.
